Women are entitled to up to four months of leave under the California Pregnancy Disability Leave Law (PDLL) if they are disabled by their pregnancy or a related condition such as a high-risk pregnancy that requires light duty and bed rest. This law applies even if the employer's policies do not offer the same treatment to employees with short-term disabilities.

After giving birth, women may take up to 12 weeks of additional leave under the California Family Rights Act (CFRA), subject to some conditions, including how long the employee has been with the employer.

Harassment, demotion or termination of employment upon request for maternity leave or giving birth is discrimination. Discrimination against women, pregnant or otherwise, is prohibited under the California Fair Employment and Housing Act.
